  • DWPI Litigation Advances to Arbitration
    Updated On: Jun 01, 2017
On October 28, 2016, NTEU Chapter 224 filed a grievance over the implementation of DWPI (Decision Writer Performance Index).   We grieved over numerous concerns, including data that showed certain EEO protected classes have lower DWPI scores.  The FSIP previously ordered the Agency to ensure that its measure was statistically valid, but the Agency implemented it anyway.  After a very long delay, the Agency finally replied to our grievance over six months later, on May 12, 2017.  They essentially deny that EEOC regulations apply to DWPI- that DWPI "is not used to determine hiring, promotion, or retention within the meaning of the [Uniform] Guidelines."  We disagree and thus our NTEU Field Counsel has invoked arbitration over this matter.  We look forward to fighting the Agency's discriminatory numeric before an arbitrator.
